1. Parties and Acceptance

These Terms of Service ("Terms") constitute a binding agreement between Ahmet Özcan ("we", "us") and any person ("User", "you") who downloads or uses the Capishify mobile application ("App").

By downloading, installing, or using the App, you represent that you have read, understood, and agreed to these Terms. If you do not agree to these Terms, do not use the App.

2. App Purpose and Limitations

Capishify is an AI-powered educational app designed to help users improve their English speaking skills. The App offers IELTS exam simulation, pronunciation analysis, interactive storytelling, podcast listening, and vocabulary learning modules.

Disclaimer

• Capishify does not guarantee any specific score on the IELTS exam.
• AI-based evaluations within the App are for guidance purposes only and do not replace official exam results.
• Evaluation results are indicative and may not perfectly align with assessments from official IELTS accredited organizations.

3. Account Creation and Security

3.1 Account Requirements

• A valid email address is required to create an account.
• Individuals under the age of 13 are not permitted to use the App.
• You are responsible for providing accurate and current information during registration.

3.2 Account Security

• You are responsible for keeping your password and session credentials confidential.
• You must notify us immediately at capishify@gmail.com if you detect any unauthorized use of your account.
• Creating an account by impersonating another person is strictly prohibited.

4. Acceptable Use

4.1 Permitted Use

The App is licensed for personal, non-commercial, educational use only.

4.2 Prohibited Activities

Users must strictly refrain from:

• Attempting to reverse-engineer, copy, or distribute any part of the App's source code
• Attempting to gain unauthorized access to the App or exploit security vulnerabilities
• Generating false, misleading, or harmful content
• Intentionally overloading the system (including DoS/DDoS attacks)
• Attempting to access other users' accounts or data without authorization
• Using the App for unlawful purposes
• Reselling or sub-licensing any part of the App for commercial purposes

Violation of these rules may result in the immediate and without-notice termination of your account.

5. Intellectual Property

5.1 App Content

All content within the App — including but not limited to software code, design, graphics, text, audio content, stories, podcasts, and other materials — belongs to Ahmet Özcan or its respective licensors and is protected by copyright law and international treaties.

5.2 User License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App subject to these Terms. This license does not permit you to copy, modify, or use any part of the App for commercial purposes.

5.3 User Content

Audio recordings you create through the App belong to you. By uploading such content to the App, you grant us a limited, royalty-free license to process, analyze, and store such content solely for the purpose of providing the service.

6. Subscriptions and Payments

6.1 Free and Premium Features

Capishify offers certain features free of charge, while premium features may require a paid subscription. Current pricing is available within the App.

6.2 Automatic Renewal

• Paid subscriptions renew automatically unless cancelled.
• You will receive a notification from the relevant store (App Store / Google Play) before renewal.
• To cancel a subscription, use the subscription management screen of the store you purchased through.

6.3 Refund Policy

Refund requests are subject to the refund policy of the platform through which the purchase was made (Apple / Google). Refund requests submitted directly to us are evaluated in accordance with the applicable store policies.

7. Service Interruptions and Changes

• We reserve the right to temporarily suspend the App without prior notice for maintenance, updates, or technical requirements.
• We reserve the right to modify, limit, or discontinue any feature of the Service.
• Users will be notified of significant changes via in-app notifications or email.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• We are not liable for indirect, incidental, or consequential damages arising from use of the App.
• We make no express or implied warranties regarding the accuracy of AI evaluation results.
• We bear no direct liability for technical failures arising from third-party service providers (OpenAI, ElevenLabs, etc.).
• We are not responsible for the content or privacy practices of third-party websites or applications linked from the App.

9. Account Termination

9.1 By the User

You may delete your account at any time using the "Delete Account" feature within the App. Deletion is permanent and irreversible. Any remaining subscription period will not be refunded.

9.2 By Us

We may suspend or permanently terminate your account without prior notice in the following circumstances:

• Violation of these Terms
• Suspected fraud or unlawful activity
• Request by competent authorities
• Extended inactivity (12 months or more — users will receive prior notification)

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Turkey. Disputes arising from these Terms shall be resolved before Istanbul Courts and Enforcement Offices.

11. Modifications to These Terms

We reserve the right to update these Terms with prior notice. Continued use of the App after the effective date of a change constitutes your acceptance of the updated Terms.
